Catastrophic impairments present a great challenge to an individual’s ability to maximize functional independence and preserve a good quality of life. A Life Care Plan (LCP) is a dynamic document based upon published standards of practice, comprehensive assessment, data analysis and research. This document provides an organized and concise plan for current and future needs and includes associated charges for individuals who have experienced catastrophic injury or have chronic health care needs. The development of the Life Care Plan includes collaboration and communication with the client, family, caregivers, and, when available, medical providers. In litigation, it gives judges and juries a clear, objective picture of future care and charges on behalf of an injured individual.
Harold Bialsky’s methodology in preparing a LCP is consistent in every case, whether plaintiff or defense. He begins with a thorough review of medical records to understand the condition. He then conducts a “day-in-the-life” interview to determine how the injury impacts daily function.
When necessary, and possible, Harold consults with treating or consulting physicians and, in cases such as traumatic brain injury, conducts collateral interviews with family or caregivers. These steps ensure that the Life Care Plan reflects all necessary recommendations for the individual.
The final plan projects needs across a lifetime, accounting for the natural convergence of aging with disability. It provides the court with a comprehensive, defensible document that explains not just immediate care, but how those needs will evolve over decades.
