A Conversation with Harold Bialsky: Why Traumatic Brain Injury Has Become the Focus of His Practice

With decades of experience in vocational rehabilitation, traumatic brain injury (TBI), Life Care Planning and expert witness services, Harold Bialsky, DC, MA, CLCP, CRC, has built a practice focused on helping attorneys navigate some of the most medically and legally complex cases. Through The Life Care Planner, he works with plaintiff and defense attorneys nationwide. We sat down with Harold to discuss why traumatic brain injury has become a primary focus of his practice, what attorneys should look for in a Life Care Planner and how his background continues to shape every case he evaluates.

Q: For attorneys who may not know you, how would you describe your practice?

Harold Bialsky: I provide Life Care Planning, vocational assessments and expert witness services for attorneys handling catastrophic injury cases. Every case is different, but my goal is always the same—to provide objective, evidence-based opinions that help attorneys understand the long-term medical, vocational and rehabilitation needs of the individual involved.

Q: Your practice has become increasingly focused on traumatic brain injury. Why?

Harold Bialsky: For me, it’s the natural progression of my career. Long before I began serving as an expert witness, I worked directly with individuals recovering from traumatic brain injuries. Early in my career, I served with Arizona’s Rehabilitation Services Administration, where I was one of only a select group of vocational rehabilitation counselors assigned exclusively to individuals with traumatic brain injuries. Later, I worked within a hospital-based neurorehabilitation program alongside neuropsychologists, physicians, occupational therapists, physical therapists and speech therapists. Those experiences continue to shape every Life Care Plan and vocational assessment I prepare today.

Q: What makes traumatic brain injury cases so challenging?

Harold Bialsky: Every traumatic brain injury is different. Two people may sustain similar injuries yet experience very different recoveries. That’s why it’s so important to evaluate not only medical treatment, but rehabilitation needs, vocational limitations, future medical costs and how the injury may affect a person’s ability to work and live independently. Those are all factors that should be considered when developing a Life Care Plan.

Q: Besides traumatic brain injury, what other types of cases do you handle?

Harold Bialsky: While traumatic brain injury has become the primary focus of my practice, I also evaluate spinal cord injuries, orthopedic trauma, neurological disorders and other catastrophic injuries. Every case requires an individualized approach because every person’s long-term needs are different.

Q: What services do attorneys typically retain you for?

Harold Bialsky: Depending on the case, attorneys may retain me for Life Care Planning, vocational assessments, loss of earning capacity analysis, future medical cost projections, medical-legal consulting or expert witness services. I work with both plaintiff and defense attorneys and remain involved throughout the litigation process whenever my expertise is needed.

Q: You often talk about having experience that goes beyond the report. What do you mean by that?

Harold Bialsky: Preparing a Life Care Plan is only part of the job. Every report I prepare is written with the understanding that it may ultimately be examined during deposition or trial. Attorneys need someone who can clearly explain the reasoning behind every opinion and remain objective throughout the legal process. That’s always been an important part of my work.

Q: Where do you typically work with attorneys?

Harold Bialsky: I regularly work with attorneys nationwide. Technology has made it much easier to collaborate with attorneys regardless of location while still providing the same level of personal attention to every case.

Q: You’ve recently expanded your educational resources. Why was that important to you?

Harold Bialsky: Education has always been an important part of my career. I wanted to create a resource where attorneys could learn more about Life Care Planning, traumatic brain injury, vocational assessments and expert witness services before they even pick up the phone. That’s why we’ve invested in a redesigned website, educational articles and videos that explain these issues in a practical, straightforward way.

Q: What would you like attorneys to know about your approach?

Harold Bialsky: My goal has always been to provide objective, well-supported opinions that attorneys can rely on. Whether the case involves traumatic brain injury or another catastrophic injury, I believe experience matters. Working directly with individuals recovering from these injuries has given me a perspective that extends beyond reviewing medical records. Every recommendation I make is grounded in rehabilitation experience, vocational expertise and evidence-based analysis.
